Folgers Being Sued For Underfilling Coffee Cans

It goes without saying that the last thing you want to do is tick off someone who hasn’t had enough coffee. So perhaps it isn’t surprising that Folger’s Coffee is the target of a lawsuit, brought by Mark Smith of Missouri.

Folger’s crime? “grossly misrepresenting” the number of cups of coffee that can be made from a canister of Folger’s Coffee. Smith’s lawsuit alleges that for42 varieties of Folger’s Coffee, a customer can make less than 70% of the number of cups of coffee indicated on the can.

This isn’t the first time Folger’s has been sued over this perceived deception, but Folger’s defense has been the same in each instance: the packaging explicitly says “up to” a certain number of cups, and how much ground coffee is used per customer per cup can vary from person to person. A judge sided with Folger’s in an earlier filing, though the plaintiff was allowed to re-file their complaint in the future. So here we are.
